Waiver/Release
This agreement includes a release of liability and waiver of legal rights and deprives you of the right to sue the owner(s) or any of the staff from Rolling Gait Canine Centre. Do not sign this agreement unless you have read and understand it in its entirety. Seek the advice of legal counsel if you are unsure of its effect.
In consideration for your dog(s) or dogs attending your classes or events to be permitted to come to Rolling Gait Canine Centre or use any of the services provided here, you agree to all of the policies, procedures, release, terms and conditions set forth below.
All Dogs must:
be current on rabies
be at least 4 months of age.
be in general good health and free of ticks and fleas
be non aggressive towards other dogs and people
meet all municipal and provincial licensure and other requirements
be leashed when entering and exiting our premises.
Personal Property
Rolling Gait Canine Centre will not be liable for any lost, stolen or damaged personal property belonging with to you, your students or those attending your events. If any visiting dog causes any damage to the facility, either indoor or outdoor, you will be liable for the full cost of all repairs and replacements.
Fees
You must pay for all services prior to taking your pet home.
Agressive Dogs
Although Rolling Gait Canine Centre loves all dogs, in order to come to our facility, no dog may not be aggressive and must pass our interview process. Your dog may be asked not to return to our facility if he/she exhibits aggressive or other unacceptable behaviour at our sole discretion.
Abandoned Dogs
You may not leave any dog here unattended. If any dog is left without any contact, instructions or notification regarding pick up, this dog will be deemed abandoned at 7:00 pm on the seventh day. If your dog is abandoned, we will become its legal owner and guardian and at our sole discretion, determine whether to re-home or relinquish it to a shelter or rescue of our choice. You fully understand and agree that if you abandon your dog here, you may be unable to retrieve possession of your dog and will have no recourse against Rolling Gait Canine Centre or it’s staff.
Duty to Disclose
You must disclose on a continuing basis, any and all medical or other conditions, including but not limited to personality concerns or behavioural incidents that may affect, limit or prevent any dogs ability to participate in any activity or services. In the event of a material change to the information you provided to us, you agree to update your profile and account within 7 days.
Acceptance and Acknowledgement of Risk
You fully understand that there are inherent and potential risks involved with interactions between humans and dogs, as well as between dogs and other dogs, which may result in property damage or bodily injury, including but not limited to, permanent disability, sickness or death to human or dog; and there may be other risks not known to you or Rolling Gait Canine Centre, nor readily foreseeable at this time. You fully accept and assume all risks and responsibility for all risks, including, without limitation, all losses, costs and damages incurred as a result of any dogs participation, including any veterinarian expenses listed below. “Sickness” includes any illness including but not limited to bordetella, bloat, canine flu, or any other form of contagious disease.
Immunization records
You agree to provide veterinary records to Rolling Gait Canine Centre upon request, and you hereby grant permission to request and obtain veterinary records directly from your designated veterinarian to release health and treatment information and immunization records to our staff upon request. You may revoke this authorization at any time upon written notice to your designated veterinarian and Rolling Gait Canine Centre.
Waiver, Release and Indemnification
You herby agree to expressly and forever generally waive, discharge claims, indemnify, release from liability, save, hold, harmless and defend Rolling Gait Canine Centre, their invitees, owners, officers, directors, employees, contractors, volunteers, agents, representatives, lessors and all others having an interest in any Rolling Gait Canine Centre party from and against any and all injury, liability, claims, litigation, actions, suits, costs, losses, damages, attorney’s fees, expenses or demands of every character whatsoever on account of, arising out of, resulting from or relating in any way to any act or omission of the Releasees, your dogs participation in any of our services. You agree that this release is binding on you and your successors, heirs, legal representatives from injury of any kind, and agree that any implementation of safety precautions by Rolling Gait Canine Centre will not waive our right to be indemnified as provided hereunder, and such precautions will not alter this release. You agree that this constitutes a complete and unconditional release of all liability of Rolling Gait Canine Centre to the greatest extent permitted by law, and that if any portion of this agreement is held to be invalid or unenforceable, the remainder of this agreement will remain in full force and effect.
Signatures and E -Signatures
By signing below, you represent and warrant that all the information you provided in the client portal is complete and accurate to the best of your knowledge. You consent to Rolling Gait Canine Centre’s use of such information for all lawful business purposes which includes, but is not limited to, providing Rolling Gait Canine Centre services to you, operating the business, marketing to you, communicating with you regarding your dog and using date that includes information about you and your dog for marketing or other purposes. You agree that we may send you emails and/or private messages regarding your transactions, including but not limited to appointment reminder, upcoming reservations, and information and pictures relating to your dog while in our care, and that your decision to opt in or out of marketing communications does not limit or prohibit our ability to communicate with you regarding these transactional matters. You further acknowledge and agree that you have read, understand and agree to all the terms and conditions contained in this Agreement, as they may be amended from time to time. You hereby execute this Agreement for your dog, yourself and your heirs, successors, representatives and assigns. You further attest that if you are not the owner or sole owner of the dog for whom this application has been completed, your signature is sufficient to enter into this agreement for and on behalf of any other owner or representative. You have read and agree that a true and correct copy of this document may be produced in lieu of the original application. Should a copy be produced, you agree that it is legally enforceable and does not affect the terms of the Agreement in any way. You acknowledge that Rolling Gait Canine Centre reserves the right to charge you a reasonable fee for the production and mailing of paper versions of this Agreement or subsequent communications. I understand that I can opt out from receiving emails by unsubscribing at any time, and I can opt out from receiving text messages by replying STOP to sender at any time.
